Fourth, keep a detailed log about where you have applied, and at what stage the company has rejected you. (is it ALWAYS at the stage where refs are being checked? ) If you get proof, ask your previous employer to cut it out. write them a letter or email.

First, worry about that later. Even if it is, lawsuits take a long time. Focus on this not being a problem for you in the short term. It likely is NOT illegal if a company you have sued makes truthful statements about the fact that you did sue them. However, if they go beyond that into actually badmouthing you or saying don’t hire her, that could possibly be illegal. Second, check your settlement agreement, if you have one. Many specifically prohibit the company from doing anything other than verifying dates of employment plus position. Even if it might not otherwise be illegal independently, if they are saying things beyond this it might be a breach of your contract. Third, Do I need a lawyer for this?
