It is commonly believed that fixed punishment should be set for all criminals in order to prevent or solve crimes efficiently. In my opinion, fixed sentences have both advantages and disadvantages from different perspectives. Firstly, setting constraint punishment for various crimes leads to speeding up the judicial process in courts. In fact, having fixed punishment in law not only will help judges to issue sentences undoubtedly but also will reduce recognition activities to realize details of crimes. For instance, issuing the death penalty for all range of murder crimes including premeditated, unpremeditated, and attempted murders, regardless of the reason or characteristics of the murder and murderer respectively, is really clear and fast. However, there is an avalanche of demerits that overshadow mentioned benefits. On the other hand, issuing similar sentences for all criminals without caring criminal’s age, kind of crime, reason of commitment, and social consequences of crime is unfair. In other words, having fixed punishment results in setting extreme sentences for various types of crimes so as to ensure the prevention of major crimes. For example, without relevant punishment, we could not set a fine or a few imprisonment sentences for a thief or shoplifter because this punishment will not prevent murders or human traffickers. Furthermore, the more setting fixed capital punishments for a lot of kinds of crimes the more leads to becoming people stressful and nervous in society due to thinking about the probability of committing crimes accidentally; however a minor crime such as driving a red light. In conclusion, albeit fixed punishment means doing judgment process on a fast track, it definitely will make people feel fear and stress and become more nervous because of doing even a minor crime unconsciously. Thus, I wholeheartedly contend that having a range of punishments related to types of crimes and traits of criminals is essential to be calm in our modern era.
